Position of MCA Deputy President

The Central Delegates at the EGM on 10 Oct 2009 have voted against Resolution 3-which called for Sdr Dato' Seri Dr Chua Soi Lek to be restored to the position of Deputy President of MCA.

This means, the intention of the Central Delegates was very clear,that they did not want Sdr Dato' Seri Chua Soi Lek to be restored as the Deputy President of MCA.

Once the EGM had adopted the Resolution, it became an order of the General Assembly which the Central Committee have to implement and the Central Committee at its meeting on 15 Oct 2009 had duly implemented it by declaring the post of MCA Deputy President vacant.

Since there was slight dispute over the meaning of Resolution 3,even though it was clear,the Central Committee invoked Article 174 of the MCA Constitution to interpret and determined the meaning of Resolution 3 ie,"that the Central Delegates at the EGM had voted against the call to restore Dato' Sri Dr Chua Soi Lek as the Deputy President of MCA."

Once the Central Committee have invoked Art 174 to interpret and determine the meaning of the order of EGM it shall become final and conclusive and shall not be questioned, challenged, reviewed or quashed by any Court of law. This position has the full support of Section 18C of the Societies Act 1966.

Following that, the Central Committee had applied Article 23 of the MCA Constitution to appoint Dato' Sri Liao Tiong Lai as Deputy President Of MCA.

The appointment of Dato' Sri Liao Tiong Lai as Deputy President of MCA was done in full compliance of the Party Constitution and there should not be any issue, doubts or queries on this matter
